Terms and Conditions

Dear Participants,

Before registration, we kindly ask you to carefully read the following points.

 

Vienna Alpine acts exclusively as a travel agent. The execution of our offerings is the responsibility of authorized mountain hiking guides (and in the case of state-certified authorized mountain and ski guides and tour guides). These guides are liability insured.

 

In the case of a mediated travel service, the travel conditions of the mediated service provider (cable car, mountain hut, tour operator, etc.) take precedence. Vienna Alpine assumes no liability for accidents, mishaps, losses, or other irregularities. Therefore, you waive any claims for damages and demands against Vienna Alpine.

 

In particular, it is pointed out that the necessary prerequisites (condition and equipment) are part of the contract between Vienna Alpine and the booking party. Participants who do not meet these prerequisites must expect to be excluded from individual (or all) hikes and tours. Course leaders and guides are authorized to exclude a participant, who evidently does not meet these prerequisites, entirely or partially from the event program at the beginning or even during the course or trip; to the extent that we save expenses, we will reimburse the participant their value. We recommend consulting a doctor before undertaking more demanding tours.

Risk:

Mountain hiking without any risk is not possible. Our guides plan their tours to the best of their knowledge and belief. Their training and sense of responsibility towards the guests can minimize the risk. However, hiking without risk is not possible even with a guide, as nature is unpredictable (storms, rockfalls, avalanches...). A degree of self-assessment and prudence is required from all participants. You should keep this in mind when booking and be aware of these circumstances.

 

Payment:

After receiving the written registration confirmation, a deposit of € 50.00 incl. 20% VAT. is due within 14 days. The remaining amount must be transferred to our account free of charge for all events no later than 21 days before the respective start. Any incurred fees must be reimbursed by you before the course begins. Rebookings are only possible up to 21 days before the start of the trip. A prerequisite for a rebooking is that the participant's request can be accommodated. For rebookings initiated by the participant, we must generally charge a processing fee of € 40.00 incl. 20% VAT. per person.

Changes and special agreements are possible on a case-by-case basis.

Exeption:

For international trips, we set individual payment deadlines.

Services:

Please refer to the descriptions and pricing information in our program offer (website, social media, flyers, outdoor advertising, etc.) for the scope of our services. All prices refer to the guide fee and the travel and meals of the mountain hiking guide. Accommodation, meals, and transportation are to be paid by the participants unless otherwise stated. There is the possibility of traveling with the hiking guide for some events. Participation in the travel costs is mandatory.

 

Vienna Alpine expressly reserves the right to declare a change in the tender details for objectively justified, significant, and unforeseeable reasons before the conclusion of the contract, about which the traveler will be informed before booking. Changes or deviations from the tender details during the trip are always possible due to the nature of a mountain trip, as the advertised travel itinerary cannot be guaranteed due to road conditions, weather changes, official arbitrariness, etc. Therefore, the tenders only represent the planned travel itinerary without guaranteeing the exact details. Side agreements that change the scope of contractual services require written confirmation. The leadership of all events and trips is usually in the hands of the hiking guides. Their instructions must be followed without fail.

 

If circumstances arise in which Vienna Alpine is forced to relocate tours to another location or cancel them altogether, no compensation claims can be made. Any additional costs incurred will be borne by the participant.

 

Withdrawal by participants due to program changes occurs under the conditions listed under the point "Withdrawal".

Insurance:

Appropriate insurance is the responsibility of the participants. We recommend taking out accident and health insurance (including rescue and recovery costs) as well as travel cancellation insurance.

Rental Equipment:

For rental equipment that we provide to our guests free of charge or for the rental fee listed in the tender, the costs for loss or repair (beyond normal wear and tear) are to be borne by the participants.

Minimum Number of Participants:

Guided tours and hikes can generally only be conducted if the required minimum number of participants is reached, unless otherwise specified in the respective travel tender. If the minimum number of participants is not reached, we are entitled to withdraw from the contract up to 1 week before the start of the trip. You will then receive the full amount of the travel price paid. If we exercise our right to withdraw, but you still wish to proceed with the trip, this constitutes a completely new offer. We can then only accept this at a newly calculated price, which we will inform you of. If you agree to the newly calculated price, a new contract will be concluded based on which the event will be conducted.

Service and Price Changes:

The printed prices correspond to the status known at the time of printing. Price changes are reserved.

Withdrawal - Cancellation Fees:

You can withdraw from the booking at any time before the trip begins. You must do so in writing for your own protection. The withdrawal becomes effective on the day it is received by Vienna Alpine. In the event of a withdrawal, the following compensations, based on the total price, will be charged:

Up to 2 weeks before: 50%

After that: 80% of the total price will be retained by us.

We recommend taking out travel cancellation insurance.

Contract Termination Due to Extraordinary Circumstances:

If the execution of an event from the program is significantly hindered, endangered, or impaired due to extraordinary circumstances that we are not responsible for (war, strike, unrest, epidemics, sovereign orders, etc.), both you and we can withdraw from or terminate the travel contract. We are entitled to appropriate compensation for already provided or still to be provided services.

Limitation of Liability:

Vienna Alpine acts as an intermediary for all events unless otherwise stated in the offer, but assumes no liability for accidents, losses, or other irregularities. Price and program changes are reserved. Prices and services include statutory taxes.

 

For all trips, participation in the mountaineering part of the event is as an independent mountaineer. Ascents and descents are at your own responsibility and risk under the guidance of the mountain and hiking guide or tour leader. A high degree of caution is required from all participants. Therefore, the organizer assumes no liability for accidents, damages, or other irregularities that occur within the mountaineering part of the trip. This is expressly confirmed by the participants through their registration. All events and trips are prepared by us with care. We cannot guarantee summit success or the fulfillment of subjectively perceived travel goals. It is inherent in the nature of such events that there remains a certain residual risk and uncertainty for the participant, which also contributes to the appeal of such events. You should be aware of these circumstances when booking.

 

The assessment of conditions and the participants' fitness levels during the trip or course, which may lead to program changes, is the responsibility of the hiking guide and cannot lead to any compensation claims. Weather, conditions, participants' fitness levels, and health aspects occasionally confront us with borderline situations during the execution of a program that are often not clearly identifiable. These dangers are known to you through the confirmed registration.

The place of jurisdiction and fulfillment is Vienna. Austrian law is agreed upon, regardless of the nationality of the participants and the location of the damage.
